Terms of Service

By creating an account or using Discoverably (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users of Discoverably, operated by Discoverably (“we,” “our,” or “us”).

Discoverably is a subscription-based SaaS platform that tracks how brands appear in responses from AI engines including Google AI Overview, ChatGPT, Perplexity, Claude, Gemini, and Copilot. The Service provides visibility scores, prompt tracking, competitor analysis, and optional Google Analytics traffic integration.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

You must provide accurate and complete information when creating your account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at support@discoverably.com

Each account may be used by one individual. You may not share accounts or create multiple accounts to circumvent plan limits.

Access to the Service requires a paid subscription. Subscriptions are billed monthly or annually in advance via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds: We do not provide refunds for partial billing periods. If you believe you were charged in error, contact us within 14 days at support@discoverably.com.
• Price changes: We will give at least 30 days’ notice before changing subscription prices. Continued use after the change takes effect constitutes acceptance.
• Failed payments: If a payment fails, we will attempt to retry and notify you. Access may be suspended if payment cannot be collected after reasonable attempts.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Scrape, crawl, or extract data from the Service through automated means beyond normal use
• Reverse engineer, decompile, or attempt to access the underlying source code
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to harm, deceive, or defraud others
• Resell or sublicense access to the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms.

Your data: You retain ownership of all data you input into Discoverably, including domain names, prompts, and brand information. By using the Service, you grant us a limited license to process this data solely to provide the Service to you.

Our IP: Discoverably, its software, design, algorithms, and all related intellectual property are owned by us. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the Service as described herein.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that AI engine data will be accurate or complete. AI engine outputs are inherently variable and outside our control.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Either party may terminate the relationship at any time. You may close your account through your account settings. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law.

Upon termination, your right to access the Service ends. We will delete your data in accordance with our Privacy Policy.

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms will be resolved in the courts of Maryland, and you consent to personal jurisdiction there.

We may update these Terms from time to time. If we make material changes, we will notify you by email or via a notice in the dashboard at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
